Estoppel Clause Prohibitions

The Five Ecclesiastical Directors CANNOT do the following without Mrs. Eddy’s consent:

1. The Five Ecclesiastical Directors CANNOT...elect “The President” of The Mother Church without “the approval of the Pastor Emeritus” (Art. 1, Sec.2, p.25);

2. The Five Ecclesiastical Directors CANNOT...elect “the Clerk and Treasurer of this Church (also...the editors and the manger of The Christian Science Publishing Society, and the Manager of the general Committee on Publication in Boston)” without “The consent of the Pastor Emeritus given in her own handwriting.” (Art. 1, Sec.3, pp.25, 26);

3. The Five Ecclesiastical Directors CANNOT...elect Readers “in the Mother Church...if she [the Pastor Emeritus] objects.” (Art. 1, Sec.4, p.26);

4. The Five Ecclesiastical Directors CANNOT... “fill a vacancy occurring THAT board” [the Board of Directors of The Mother Church] unless “the candidate is approved by the Pastor Emeritus.” (Art. 1, Sec.5, p.26).

5. The Five Ecclesiastical Directors CANNOT...form Trusteeships or Syndicates without “the approval of the Pastor Emeritus.” (Art. 1, Sec.8, p.27);

The first five prohibitions prevent the continuance of The Mother Church after 1910

6. The Five Ecclesiastical Directors CANNOT...remove an “inadequate or unworthy...Reader in The Mother Church” without “the consent of the Pastor Emeritus...” (Art.2. Sec.3, p.30);

7. The Five Ecclesiastical Directors CANNOT...allow the “First Reader of the Mother Church [to] occupy, during his term of Readership, the house of the Pastor Emeritus, No. 385 Commonwealth Avenue, Boston...” unless “the occupants are satisfactory to [Mrs. Eddy].” (Art.2, Sec.4, p.30);

8. The Five Ecclesiastical Directors CANNOT...elect “the individuals who take charge of the Reading Room of The Mother Church” (the Librarian) without “the approval of Mary Baker Eddy.” (Art.21, Sec.2, p.63);

9. The Five Ecclesiastical Directors CANNOT...appoint the “Committee on Finance” without “the consent of the Pastor Emeritus.” (Art.24, Sec.4, p.76);

` 10. The Five Ecclesiastical Directors CANNOT...make “Donations from this Church” without “the written consent of the Pastor Emeritus.” (Art.24, Sec.7, p.78). Mrs. Eddy made her donation individually outside of the church;

11. The Five Ecclesiastical Directors CANNOT...sanction “important movements of the Committee on Publication” without “the approval of Mary Baker Eddy. (See Art.1, Sec.6).” (Art.24, Sec.7, p.78);

12. “...elect a Committee on Business...of The Mother Church” unless their names “shall be presented to Mrs. Eddy for her written approval” (Art.24, Sec.9, p.79);

13. The Five Ecclesiastical Directors CANNOT...fill...a vacancy in the Trusteeship of the Christian Science Publishing Society by appointment without “her [Mrs. Eddy’s] approval.” (Art.25, Sec.3, p.80). This By-Law was overridden by Mrs. Eddy’s 1898 Deed of Trust in 1910;

14. The Five Ecclesiastical Directors CANNOT...elect “the editors and manager of The Christian Science Publishing Society” without “the consent of the Pastor Emeritus given in her own handwriting.” (Art.25, Sec.4, p.80);

15. The Five Ecclesiastical Directors CANNOT...accept an employee of the Christian Science Publishing Society to “bee connected with publishing her books, or with editing or publishing [her periodicals], or with the Christian Science Publishing Society...who is not accepted by the Pastor Emeritus...” (Art.25, Sec.5, p.81);

16. The Five Ecclesiastical Directors CANNOT...elect “the vice-president” or “the teacher” of the Board of Education of the Massachusetts Metaphysical College without “the approval of the Pastor Emeritus.” (Art.28, Sec.2, p.88);

17. The Five Ecclesiastical Directors CANNOT...fill a vacancy “should the President [of the Board of Education] resign over her own signature or vacate her office of President of the Massachusetts Metaphysical College” without “receiving her [Mrs. Eddy’s] approval...” (Art.28, Sec.4, p.89);

18. The Five Ecclesiastical Directors CANNOT...elect the Members of the Board of Lectureship without “the approval of the Pastor emeritus.” (Art.31, Sec.1, p.93);

19. The Five Ecclesiastical Directors CANNOT...“appoint a circuit lecturer” without the “request of Mrs. Eddy.” (Art.31, Sec.4, p.94);

20. The Five Ecclesiastical Directors CANNOT...elect the Committee on Publication of the Mother Church without “the consent of the Pastor Emeritus given in her own handwriting...” (Art.33, Sec.1, p.97);

21. The Five Ecclesiastical Directors CANNOT...appoint an assistant to the manager of the general Committee on Publication without “the approval of the Pastor Emeritus...” (Art.33, Sec.6, p.101);

22. The Five Ecclesiastical Directors CANNOT...revise “The Church Manual of The First Church of Christ, Scientist, in Boston, Mass., written by Mary Baker Eddy and copyrighted [that] is adapted to The Mother Church only...without the written consent of its author.” (Art.35, Sec.1, p.104);

23. The Five Ecclesiastical Directors CANNOT...adopt nor annul any “new Tenet or By-Law...without the written consent of Mary Baker eddy, the author of our textbook, SCIENCE AND HEALTH.” (Art.35, Sec.3, p.105.
