The Chief Justice of the Full Bench found the Directors of TMC and their attorney,
Clifford P. Smith, guilty of acting in contempt of the Master's injunction and required
them to pay a fine or go to jail. (Christian Science Today, by Charles S. Braden,
pages 81, 82).
The honorable Charles Evens Hughes -- who later became
Chief Justice of the United States Supreme Court -- saw the issue clearly and in
his summary argument for the Publishing Society, said: "There are two concepts
of harmony. One concept is the harmony produced by obedience to despotic power; the
other concept is the harmony that results from the unity of ideas and common views
of a religious truth. It seems to us most unjust to Mrs. Eddy, most contrary to her
teachings, to assume for one moment that she relied upon the exercise of the despotic
power which these Directors have arrogated to themselves. The unity which these [Directors]
wish to maintain -- the unity of despotic power; the absolute control of the entire
government of Christian Science in the church, and in the publications, and everywhere
else -- is the unity which might well destroy the very faith of the organization
established to propagate the faith to which they profess to be devoted..
