Memo-21
First Things First

No new information has surfaced since the hearing. The only question on the table at this time is simply the opening question of standing. The directors claim that I do not have standing, and I claim that I do. The judge has been given enough information on which to decide this question. If the judge decides that I have standing, the complaint will be recognized, addressed, and resolved.

The issue of standing (the right to sue) is always the first step in any suit.

Note this: the complaint was NOT considered to be a frivolous complaint.

frivolous, adj. Lacking a legal basis or legal merit; not reasonably purposeful. (Black's Law Dictionary, 7th, page 677).
