1. According to the 1903 Deed Agreement, when any By-Law is annulled, the four-man
Board of Directors of the First Church of Christ, Scientist, in Boston, Massachusetts
become guilty of a civil violation of a civil trust instrument.
2. The Supreme
Court of Massachusetts rendered their opinion (not a ruling) that the estoppels in
the Manual of the First Church of Christ, Scientist, in Boston, Massachusetts are
valid, and these estoppels have been violated by the four-man Board of Directors
of the First Church of Christ, Scientist, in Boston, Massachusetts through their
annulment of the stipulation in Mrs. Eddy's 1903 Deed of Trust that annulling any
By-Law in the Manual must not be done.
3. By declaring the estoppels binding,
the Supreme Court of Massachusetts immediately dissolved the five-man Board of Directors
established under the Manual of the Mother Church, and the four-man Board of Directors
established under Mrs. Eddy's 1892 and 1903 Deeds of Trust which they have to uphold,
honor, and carry out on her confidence and trust.
4. Since it would now be
impossible to determine which of the existing five Directors of the Mother Church
are in fact the four Directors of The First Church of Christ, Scientist, in Boston,
Massachusetts, under the fiduciary instrument under the jurisdiction of the Court,
one of the five Directors should resign or otherwise vacate his office, while the
remaining four would be the ones who are guilty in the eyes of the law, since they
would be the residuary body that is unable to appoint a fifth member to fill the
vacancy due to the estoppel in Article 1, Section 5 of the church Manual, on page
26.
5. Thusly, we and the Court would find the ecclesiastical church and its
five-man Board of Directors dissolved.
6. The Extension would continue as
a branch of The First Church of Christ, Scientist, in Boston, Massachusetts, on an
equal footing with all other branch Churches of Christ, Scientist throughout the
world. No new branch Church could be formed; only Societies of Christ, Scientist,
could be formed. (Man. Article 23, Section 6, 19-24, page 72).
7. The Christian
Science Publishing Society would continue under Mrs. Eddy's 1898 Deed of Trust which
guarantees its operation independent of The First Church of Christ, Scientist, in
Boston, Massachusetts, established under Mrs. Edd's 1892 Deed of Trust.
8.
Ownership of The Christian Science Monitor would be transferred to its past and present
employees, and the Periodicals would cease.
9. Only the Christian Science
Quarterly, the 88th Manual of The First Church of Christ, Scientist, in Boston, Massachusetts,
and the already published writings of Mary Baker Eddy would remain.
10. Reprints
of the already published Periodicals, up .till 1910, would be allowed.
11.
Each branch of The First Church of Christ, Scientist, in Boston, Massachusetts, would
continue its democratic form of government in consonance with the Manual of The First
Church of Christ, Scientist, in Boston, Massachusetts. (consonance = "harmony
and agreement with components") (syn. consistent; compatible.) The Manual Estoppels
Govern.
