1. Eight years after Mrs. Eddy passed on, a controversy occurred which is now
called the "great literature litigation of 1919-1921." This court action
has been completely misrepresented to the Field, and the important "opinions"
of the court have been ignored by the Boston hierarchy.
2. How can this happen
when the findings of the court are in the form of a public document? Well, the KGB,
and their "department of disinformation," played a key role in the former
Soviet Union.
3. Ever since the movement was seized by the then Board of Directors
at the instant of Mrs. Eddy's passing, in 1910, disinformation has been used to its
full advantage by the Boston authorities, to convince the Field that the Supreme
Court of Massachusetts ruled in its 1921 Decision that the Directors could govern
the movement forever; but this is not true.
4. Herbert W. Eustace, C.S.B.
and Chief Trustee of the Christian Science Publishing Society, states in his book,
Christian Science: Its Clear Correct Teaching, that: ."On March 6, 1920,
Judge Dodge handed down his final report, finding for the Trustees in all of the
essential facts, and making his rulings of law in conformity with these facts."
(page 39).
5. However on the next page we read that, "A different decision
was handed down on November 23, 1921. The Master's finding of facts was undisputed,
but the Supreme Court of Massachusetts reversed the ruling of law as handed down
by Judge Dodge. When the Supreme Court handed down its decision reversing the Master's
findings of law, the Trustees were glad to resign their offices and elect new Trustees
in subordination to the Directors, and to turn over to them immediately the business
of the Publishing Society."
6. It is clear from these statements that
Herbert Eustace believed that by Judge Dodge's reversal of the Master's interim injunction,
the Court had ruled in favor of the Board controlling the movement forever. But Herbert
Eustace was wrong.
7. However, it is obvious that the Boards, ever since,
have been eminently satisfied with this misinterpretation of the Court's findings
at law, and have perpetuated this misunderstanding in the Field, over the years,
-- and no-one has questioned it as a member in good standing and survived recognition
by the Board.
8. Many Christian Scientists today have never heard of the Litigation.
Most Christian Scientists who have, shrug off the mention of the Litigation as simply
whipping a dead horse. But there is no statute of limitation applicable to the removal
of an erroneous condition of fraud.
9. Christian Scientists have the tools
to correct these problems without resorting to war. Those who can, must do so without
further delay.
10. Through a Deed of Trust, Mrs. Eddy established The Christian
Science Publishing Society on January 25, 1898. Its purpose was "for more effectually
promoting and extending the religion of Christian Science as taught my me."
(Mrs. Eddy).
11. Mrs. Eddy named three self-perpetuating Trustees in this
irrevocable Deed of Trust.
12. The three Trustees signed the deed, indicating
their acceptance thereof. And every succeeding trustee signed and dated his acceptance
as well. The last three were trustees until their forced resignation effective on
the 29th of January, 1922, after an thorough audit of the books.
13. In mid-year
1898, Mrs. Eddy instituted new By-Laws which brought The Christian Science Publishing
Society under the church Manual. However, not all of the conditions of the 1898 Deed
of Trust were recited in the church Manual. And the church Manual contained material
concerning the Publishing Society that was not contained in the Deed of Trust.
14.
At first glance, this would appear to lead to the disputes after our Leader.s demise,
but had Mrs. Eddy's Manual instructions been obeyed, as she intended that they must
be, the dispute that culminated in the "Great Literature Litigation" would
not have taken place.
15. But the five-member ecclesiastical Board of Directors
rejected the estoppels and took control of the entire church and the movement, in
a bloodless coup.
