SUMMARY OF ARGUMENT

1. The Crux of this Civil Courtcase is that the voluntary association’s MANUAL (of by-laws) has been changed contrary to the specific directions of the association’s Chief Executive Officer (CEO) and Pastor Emeritus, The Rev. Mary Baker G. Eddy.

2. The Deed Restriction published in the 1903 “Deed for Church Purposes” (Exh. B, Man. at 136) and duplicated in all of the other real estate deeds of trust has been breached by the five APPELLEES so they must surrender their office as Directors to four Director/Trustees of The First Church of Christ, Scientist, in Boston, Massachusetts, under the 1892 “Deed Conveying Land for Church Edifice” (Exh. A. Man. at 128) who will promise “to honor and obey” the by-laws in the Manual and the Deed Restrictions in the foundational Deeds of Trust.

3. The five-member predecessor Board of the APPELLEES (the ecclesiastical Directors of The Mother Church) confirmed their agreement to resign (to make place for the four Director/Trustees of The First Church of Christ, Scientist, in Boston, Massachusetts) when they signed an INDENTURE with Mary Baker G. Eddy, six months after the Extension was completed; on December 19, 1906.
