The Crux Of The Civil Courtcase

1. The Crux (the puzzling problem) of the Civil courtcase is that the Manual has been changed (the Manual has been revised).

2. The 1903 Deed Restriction* has been many times breached, therefor the five Directors of The Mother Church must resign and be replaced by four Trustees of The First Church of Christ, Scientist, in Boston, Massachusetts, who will honor the Deeds of Trust.

3. This Deed Restriction “runs with the land,” and is “enabled” by the “Second Witness” penalty** for disobedience.

4. Due to the “Conflict of Interest” caused by the fact that the Clerk is also a Director of The Mother Church, the Court is being moved to “sustain” or “overrule” the validity of the Complaint that requires the five Directors of The Mother Church to resign, to make place for four Trustees of The First Church of Christ, Scientist, in Boston, Massachusetts, who will honor the Deeds of Trust.

*“. . . this property is conveyed on the further trusts that no new Tenet of By-Laws shall be adopted, nor any Tenet or By-Law amended or annulled by the grantees unless the written consent of said Mary Baker G. Eddy, the author of the textbook “Science and Health with Key to the Scriptures,” be given therefor . . .” — 1903 Deed Conveying Land for Church Purposes, Manual, at 137.

**“If the Christian Science Board of Directors fails to fulfil the requirements of this By-Law, . . . and any member of this Church, and especially . . . one who has been or who is the First Reader of a church, . . . shall complain thereof to the Clerk and the complaint be found valid, the Directors shall resign their office . . .” — Manual, Art. 1, Sec. 9, p.29.
